By accessing or using bikeslop.com (the "Site"), you agree to be bound by these Terms of Use and our Privacy Policy, which is incorporated by reference. If you do not agree to these terms, you should not use the Site. Your continued use of the Site after any changes constitutes acceptance of the revised terms.
2. Description of Service
BIKESLOP, operated by D.A. Legacy Group LLC, is a directory of bike parks, pump tracks, dirt jumps, skills parks, indoor parks, skateparks, bike shops, and related riding facilities across North America. The Site provides location information, facility details, interactive maps, embedded video content, user-submitted listings, and premium listing services to help riders discover places to ride and businesses to support.
3. User Accounts
Certain features of the Site require you to create an account through our third-party authentication provider (Manus OAuth). By creating an account, you agree to the following:
- You will provide accurate and complete information during the registration process.
- You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
- You will notify us promptly of any unauthorized use of your account.
- We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these terms.
4. Accuracy of Information
While we strive to maintain accurate and current information, we make no warranties or representations regarding the completeness, accuracy, or reliability of any content on the Site. Listing information — including park hours, fees, conditions, amenities, and availability — is sourced from public data, third-party APIs (including Google Places), and user submissions, and may change without notice. You are responsible for verifying information directly with the facility before visiting. We recommend contacting parks and shops directly to confirm current operating status, pricing, and conditions.
5. Assumption of Risk
Mountain biking, BMX riding, skateboarding, and related activities are inherently dangerous and carry a risk of serious injury or death. By using this Site to find riding locations, you acknowledge that you participate in these activities entirely at your own risk. Find A Bike Park does not inspect, endorse, or certify the safety of any facility listed on the Site. We are not responsible for any injuries, damages, or losses that may occur at any facility listed on the Site. Always wear appropriate safety equipment, ride within your ability, and follow all posted rules and regulations at each facility.
6. User Submissions
When you submit park or shop information, corrections, photos, videos, or other content through the Site (collectively, "User Content"), you agree to the following:
- You grant D.A. Legacy Group LLC a non-exclusive, royalty-free, perpetual, worldwide license to use, modify, publish, display, and distribute your User Content in connection with the Site and its promotion.
- You represent and warrant that you own or have the necessary rights to submit such content and that it does not infringe on any third party's intellectual property, privacy, or other rights.
- You will not submit content that is false, misleading, defamatory, obscene, or otherwise objectionable.
- We reserve the right to review, edit, approve, or remove any User Content at our sole discretion without notice.
7. Listing Claims and Premium Services
The Site offers the ability for business owners to claim their listings and purchase premium listing services. By claiming a listing or purchasing a premium service, you agree to the following:
- Verification: We may require you to verify your ownership or authorized representation of the business before approving a listing claim.
- Accuracy: You are responsible for ensuring that all information you provide for your claimed listing is accurate and current.
- Premium Features: Premium listing services may include enhanced visibility, featured placement, and additional media. The specific features, pricing, and duration of premium services are described at the time of purchase.
- No Guarantee of Results: Premium placement does not guarantee any specific level of traffic, leads, or business outcomes.
8. Payments and Refunds
All payments for premium services are processed securely through Stripe, Inc. By making a purchase, you agree to the following:
- All prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes may be added at checkout.
- You authorize us to charge the payment method you provide through Stripe for the total amount of your purchase.
- Subscription-based services will renew automatically at the end of each billing period unless you cancel before the renewal date.
- Refund requests must be submitted within 14 days of purchase. Refunds are issued at our discretion and may be prorated for partially used service periods.
- Your use of Stripe's payment services is subject to the Stripe Terms of Service.
9. Intellectual Property
All content on the Site, including text, graphics, logos, design elements, software, and the compilation and arrangement of listings, is the property of D.A. Legacy Group LLC or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent. The BIKESLOP name, logo, and all related marks are trademarks of D.A. Legacy Group LLC.
10. Prohibited Conduct
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable laws or regulations
- Submit false, misleading, or fraudulent information, including fake listings or reviews
- Attempt to gain unauthorized access to any part of the Site, other users' accounts, or our systems and infrastructure
- Use automated tools, bots, or scrapers to extract data from the Site beyond what is permitted by our robots.txt file
- Interfere with or disrupt the Site's infrastructure, security features, or other users' access
- Impersonate any person or entity, or falsely claim an affiliation with any person or entity
- Use the Site to transmit spam, malware, or any harmful code
- Claim a listing for a business you do not own or are not authorized to represent
11. Third-Party Services and Content
The Site integrates with and displays content from third-party services. Your use of these services is subject to their respective terms:
- Google Maps: Interactive maps are provided through the Google Maps API. Your use is subject to the Google Maps Terms of Service.
- YouTube: Embedded videos are provided through YouTube. Your use is subject to the YouTube Terms of Service.
- Stripe: Payment processing is provided by Stripe. Your use is subject to the Stripe Terms of Service.
- External Links: The Site may contain links to third-party websites, including park and shop websites. These links are provided for convenience only. We do not endorse, control, or assume responsibility for the content or practices of any third-party sites.
12. Copyright Infringement (DMCA)
If you believe that content on the Site infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) by contacting us. Your notice must include: (a) a description of the copyrighted work you claim has been infringed; (b) the URL or location on the Site where the infringing material is located; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, D.A. LEGACY HOLDINGS LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, ANY INFORMATION OBTAINED THROUGH THE SITE, OR ANY TRANSACTION CONDUCTED THROUGH THE SITE. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, LOSS OF REVENUE, OR LOSS OF BUSINESS OPPORTUNITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US DURING THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify, defend, and hold harmless D.A. Legacy Group LLC, its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your User Content; (d) your violation of any third party's rights; or (e) any fraudulent listing claim or misrepresentation of business ownership.
16. Governing Law and Dispute Resolution
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to its conflict of law provisions. Any dispute arising under or relating to these terms shall first be submitted to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be subject to the exclusive jurisdiction of the state and federal courts located in Idaho. For users located in Canada, nothing in these terms limits your rights under applicable Canadian consumer protection legislation.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
